The D.C. Circuit Court of Appeals today rebuked the first legal challenge to the U.S. Environmental Protection Agency’s proposal to cut global-warming pollution from the nation's power plants. In a straightforward ruling, the court said the states and the industry groups had no legal grounds to challenge EPA’s “Clean Power Plan” since it has yet to be finalized.

By juxtaposing the boom and bust coal industry that has long dominated the landscape with the current natural gas boom, Kernan hopes to promote an important conversation about the type of future West Virginians want to create.

It’s rare that Appalachians have their voices heard in Congress. But twice in the past month, residents have had the opportunity to testify about mountaintop removal mining at two different U.S. House hearings. The lesson we learned? Congress does not want to help end mountaintop removal and they’d prefer not to hear about it.

The communities near Duke Energy's Belews Creek power plant and coal-ash dump in North Carolina have suffered a long time from water pollution. Now the state is poised to allow the natural gas industry to drill fracking wells nearby. Citizens are saying "enough." The NAACP announced a civil rights investigation at a recent press conference and took its protest to the state capitol at a "Moral Monday" rally.
